What is an Easement?

An easement is a legal right allowing someone to use another person’s property for a specific purpose. While it grants usage rights, it doesn’t provide ownership. Easements are crucial in property law, helping manage land use between neighbors and ensuring smooth real estate transactions.

Types of Easements

• Easement Appurtenant
○ Involves two pieces of land: the dominant estate (benefits) and the servient estate (bears the burden).
○ Transfers with the property when sold.

• Easement in Gross
○ Linked to a person or entity, not a specific piece of land.
○ Commonly held by utility companies for installing and maintaining infrastructure.
○ Does not automatically transfer with property sales.
